UPPER TOWNSHIP BASKETBALL ASSOCIATION

RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND COVENANT NOT TO SUE

In consideration of my participation, or my child's participation, in basketball activities and programs conducted by the Upper Township Basketball Association ("UTBA"), I acknowledge and understand that participation in basketball and related recreational activities involves inherent risks of injury. These risks may include, but are not limited to, falls, collisions, contact with other participants, injuries resulting from playing surfaces or equipment, and other risks associated with participation in basketball and related activities.

I voluntarily assume all such inherent risks and agree to release and hold harmless the Upper Township Basketball Association, its Board Members, officers, coaches, instructors, coordinators, volunteers, agents, and representatives (collectively, the "Released Parties") from claims for personal injury, property damage, or death arising from or related to participation in UTBA activities, to the fullest extent permitted by New Jersey law, including claims arising from the ordinary negligence of the Released Parties.

I further agree that I will not bring or maintain any claim or lawsuit against the Released Parties for injuries, damages, or losses covered by this agreement, to the extent such claims arise from the ordinary negligence of the Released Parties.

I understand that participation in basketball can involve vigorous physical activity and carries risks that may result in serious injury, including, but not limited to, broken bones, sprains, strains, head injuries, neck or spinal injuries, paralysis, or, in rare circumstances, death. I knowingly and voluntarily accept these risks.

I understand that this release does not apply to conduct for which liability cannot legally be waived under New Jersey law, including willful, wanton, or grossly negligent conduct, or any other conduct for which New Jersey law does not permit a waiver or release.

I further agree to indemnify and hold harmless the Released Parties from claims, damages, liabilities, costs, or expenses arising from my participation, or my child's participation, in UTBA activities, to the extent permitted by New Jersey law.

I understand that this agreement is intended to be as broad and inclusive as permitted by the laws of the State of New Jersey. If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I acknowledge that I have carefully read this agreement and understand its terms. I understand that by signing this agreement, I am giving up certain legal rights, including the right to pursue claims against UTBA, its Board Members, coaches, instructors, coordinators, volunteers, and agents for claims arising from their ordinary negligence, to the extent permitted by New Jersey law.

For Participants Under 18 Years of Age

I represent that I am the participant's parent or legal guardian and that I have the legal authority to enter into this agreement on the participant's behalf. I consent to the participant's participation in UTBA activities and agree to the terms of this Release of Liability, Assumption of Risk, and Covenant Not to Sue on behalf of myself and, to the extent permitted by law, the participating minor.

By completing registration, I acknowledge that I have read, understand, and voluntarily agree to the terms of this agreement.
